Who Qualifies for Infertility Coverage?
In Illinois, infertility is defined as:
- The inability to achieve or maintain a pregnancy after 12 months of unprotected intercourse (if under age 35) or 6 months (if over 35).
- The inability to conceive without medical intervention, including for individuals without a partner.
- A physician’s diagnosis based on medical history, age, and reproductive health.
- Infertility caused by medical treatments such as chemotherapy, radiation, or surgery (iatrogenic infertility).
What Does Illinois Insurance Cover for Fertility Treatment?
Illinois law requires group insurers and HMOs that offer pregnancy-related coverage to also cover a broad range of infertility treatments, including:
✔ Diagnosis of infertility
✔ In vitro fertilization (IVF)
✔ Embryo transfer & uterine embryo lavage
✔ Artificial insemination
✔ Gamete Intrafallopian Transfer (GIFT) & Zygote Intrafallopian Transfer (ZIFT)
✔ Low tubal ovum transfer
For IVF, GIFT, and ZIFT, coverage is available if the patient has first attempted less costly, medically appropriate treatments.
Egg Retrieval Coverage & Lifetime Limits
Each patient is eligible for coverage of up to four egg retrievals. If a live birth occurs, two additional retrievals may be covered, with a lifetime maximum of six retrievals.
Fertility Preservation for Medical Treatments (Iatrogenic Infertility)
If a necessary medical treatment, such as chemotherapy or surgery, may result in infertility, Illinois law requires insurers to cover medically necessary standard fertility preservation services, including egg and embryo freezing.
Insurance Restrictions & Exceptions
- Policies cannot impose additional restrictions on fertility medications or services beyond those for other medical treatments.
- Employers with fewer than 25 employees are not required to provide coverage.
- Religious employers are exempt from covering infertility treatments.
- Self-insured employers are not subject to Illinois insurance mandates.
