As of January 1, 2023, large group health plans issued or renewed in Colorado are required to cover the diagnosis and treatment of infertility as well as standard fertility preservation. Importantly, these benefits are not limited by marital status, gender identity, or sexual orientation. This means that LGBTQIA+ individuals—whether partnered or single—may be eligible for services such as:
- Diagnostic testing and fertility evaluations
- IVF and IUI procedures
- Egg or sperm retrieval and preservation when medically necessary
- Fertility medications, covered at the same level as other prescriptions
However, not all services are guaranteed under every plan. Some costs associated with third-party reproduction, such as donor gametes or surrogacy arrangements, may not be fully covered. In addition, self-insured employers, small group plans, and religious organizations may be exempt from the state mandate.
