Inclusive Fertility Insurance Coverage Options in California

California’s fertility insurance laws are evolving to make care more accessible and inclusive for individuals and families, no matter their path to parenthood. If you’re pursuing LGBTQIA+ family building through IVF, reciprocal IVF, fertility preservation, or donor-assisted reproduction, recent changes to California law may expand your coverage options.

Beginning July 1, 2025, many fully insured large group health plans in California will be required to cover the diagnosis and treatment of infertility, including up to three completed egg retrievals and unlimited embryo transfers, following American Society for Reproductive Medicine (ASRM) guidelines. These changes stem from Senate Bill 729 and reflect a growing commitment to inclusive reproductive care.

The law also recognizes a broader definition of infertility. That means you may qualify for coverage whether you’re an individual, a same-sex couple, or someone planning fertility preservation before medical treatment such as chemotherapy.

Coverage may include:

  • Infertility diagnosis and treatment
  • In vitro fertilization (IVF)
  • Medically necessary fertility preservation (egg, sperm, or embryo freezing)
 

It’s important to note that insurance requirements differ based on your plan:

  • Large group plans (101+ employees): Must include IVF and fertility preservation
  • CalPERS (state employees): IVF coverage begins January 1, 2027
  • Small group plans (100 or fewer employees): Must offer infertility benefits, but IVF is not required
  • Self-insured employers and religious organizations: Exempt from coverage requirements
