Effective January 1, 2021, Maryland’s infertility insurance law no longer has a marriage requirement, and the two-year “waiting” period has been reduced to one year of sexual intercourse or three attempts of artificial insemination in the course of a year.

The state of Maryland enacted the first state infertility mandate in 1985 requiring insurance companies to cover infertility treatment. The Maryland infertility mandate was led through a grass-roots campaign and paved the way for 17 other states that now have laws requiring insurance companies to cover or offer coverage for infertility treatment. Over the years, the law has seen several revisions adjusting to the changing times.
In 2018, Maryland became the 3rd state to cover fertility preservation for cancer patients when SB271 passed unanimously.
